2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use our services. Where a service involves financial transactions, you must also meet any additional eligibility and verification requirements we or our partners specify. We may require proof of identity and may decline or withdraw access where verification fails or where the law requires it.

3. Your account

  • You must provide accurate, current, and complete information.
  • You are responsible for keeping your credentials and device secure.
  • You must tell us promptly if you suspect unauthorised access or fraud.
  • You may not share your account, or sell, transfer, or assign it.
  • We may suspend or close an account for breach of these Terms, fraud, or legal requirement.

4. Acceptable use

You agree not to:

  • use our services for any unlawful purpose, including money laundering, terrorist financing, fraud, or the funding of illegal activity;
  • impersonate any person or misrepresent your affiliation;
  • interfere with, disrupt, or attempt to gain unauthorised access to our systems or those of our partners;
  • reverse-engineer, decompile, scrape, or copy our applications or content except as permitted by law;
  • introduce malware or any harmful code;
  • use our services in a way that damages or overloads our infrastructure or that of third parties; or
  • violate any applicable law or regulation.

5. Financial services and third-party providers

Certain features may be provided in conjunction with licensed financial institutions, mobile-money operators, payment processors, or other partners. Those services may be governed by additional terms and by the partner's own policies. Where a partner is the regulated provider, we act as a technology provider and not as the financial institution.

Regulatory status: Shanghai Kaiyuan Technology Company Limited is a technology company. It is not itself a licensed bank, insurer, or deposit-taking institution, and it does not hold a consumer-lending licence in any market. Where a feature involves regulated financial activity, that activity is provided by a licensed partner under the partner's own authorisation, or it is not offered. Any future licensing or registration will be published here.

6. Fees, transactions, and errors

Fees, limits, and exchange rates are disclosed in the relevant application before you confirm a transaction. Once a transaction is confirmed and processed it may be irreversible, as is typical for electronic payments. If you believe a transaction is erroneous or unauthorised, contact us promptly at [email protected]; our ability to reverse a transaction depends on the rules of the underlying payment network and applicable law.

7. Intellectual property

Our services, including all software, text, graphics, logos, and the "Kaiwish Technology" name and marks, are owned by us or our licensors and protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use our applications for their intended purpose. All other rights are reserved.

8. Third-party services

Our services may integrate with third-party platforms, including Google Play and Google services, and may contain links to third-party sites. We do not control and are not responsible for third-party services, content, or practices. Your use of them is governed by their own terms.

9. Availability and changes

We aim to keep our services available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the services, and may update these Terms, at any time. Material changes will be notified through the application, by email, or on this page. Your continued use after changes take effect constitutes acceptance.

10. Disclaimers

To the maximum extent permitted by law, our services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, secure, or free of errors, or that defects will be corrected.

11. Limitation of liability

To the maximum extent permitted by law, Kaiwish and its directors, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of the services. Our total aggregate liability for all claims relating to the services is limited to the greater of (a) the total amount you paid us for the affected service in the 12 months immediately preceding the event giving rise to the claim, or (b) USD 100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including for fraud or death or personal injury caused by negligence, where such law applies.

12. Indemnity

You agree to indemnify and hold harmless Kaiwish and its officers, directors, employees, and partners from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the services, or your violation of any law or third-party right.

13. Termination

You may stop using our services at any time and may request account deletion as described in our Account & Data Deletion page. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the service. Provisions that by their nature should survive termination will do so.

14. Governing law and disputes

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. The courts of Shanghai, China have exclusive jurisdiction, except that — where mandatory consumer-protection or data-protection law in your country of residence gives you the right to bring proceedings locally, or prohibits exclusive foreign jurisdiction — that law prevails over this clause, and you may bring proceedings in your local courts.

15. General

If any provision of these Terms is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent; we may assign ours in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the services.
